1. Seller
The 3DVue service is published and sold by Thibaut Perrin, sole proprietorship (EI), trading as 3DVue, SIRET 498 060 805 00047, EU VAT number FR53498060805, 10 impasse du Pignanen, 34660 Cournonterral, France (hereinafter "3DVue"). Contact: support-client@3dvue.fr.
2. Scope
These terms and conditions of sale apply to any account creation and any purchase on the 3DVue service, by a business customer (a person acting for the needs of their commercial, industrial, craft, professional or agricultural activity) or by a consumer (a natural person acting for personal purposes). Clauses specific to one of these two categories state so.
Creating an account and each purchase imply acceptance of these terms, which prevail over any other document, in particular the customer's own purchase conditions. The applicable version is the one in force on the date of purchase. 3DVue may amend these terms; the subscribed customer is notified by email at least 30 days before they take effect and may, if they refuse them, cancel their subscription free of charge before that date.
The fact that 3DVue does not invoke a clause of these terms at a given time does not constitute a waiver of the right to invoke it later.
3. Description of the service
3DVue is a self-service 3D configurator, hosting included: the customer creates an account, hosts 3D models and materials on it, configures a scene and a render, then embeds an interactive 3D configurator on their own site (link, iframe or widget). An AI product-image generation option (AI Photo Studio) is offered to subscribers. The features of each plan are described on the Our plans page.
The images and visuals shown on the 3DVue site are for illustration purposes. Images generated by the AI Photo Studio are produced by an artificial intelligence model: results may vary from one generation to another.
From the Starter plan onward, support is provided by email at support-client@3dvue.fr, Monday to Friday, 9am to 6pm, within the response time indicated for each plan on the Our plans page; the Free plan includes the online documentation. Video troubleshooting and training sessions are offered separately, for a fee, by appointment set after payment. Any request for custom development is subject to a separate quote.
4. Account and free trial
The customer provides accurate and up-to-date information and must not create an account under a false identity. Their access is protected by a personal password they keep confidential; they report any fraudulent use of their account without delay.
Creating an account gives access to a 90-day free trial (Free plan, limits shown on the Our plans page), no credit card required. The trial is offered only once. At the end of it, without a paid subscription, the account is paused: the configurator is no longer displayed on the customer's site and the customer area is no longer accessible, but no data is deleted; subscribing to a paid plan reactivates the account.
5. Plans, prices and billing
Each plan sets the number of products and materials active at the same time. The customer can change plan at any time from their area ("My account"). Paid plans are billed by monthly or annual subscription. The annual plan is paid in one go, with one month free compared to twelve months paid at the monthly rate. A paid plan change is calculated pro rata and appears on the next invoice. There is no billed overage: at the plan's limit, adding a product or material is blocked until another item is paused or the customer upgrades to a higher plan. When downgrading, no data is deleted: items beyond the new limit are paused and the customer chooses which ones stay active.
Prices are shown excluding tax. The applicable VAT is calculated based on the customer's country and the total amount including tax is shown before payment is confirmed, then detailed on the invoice. Business customers in the European Union can enter their EU VAT number at checkout; VAT is then reverse-charged according to applicable regulations. Invoices are available in the customer area and a receipt is emailed for every payment.
6. Payment
Payments are made in euros, by card, via the secure payment provider Stripe. 3DVue does not store any card data. The subscription is charged at the start of each period, monthly or annually.
If a charge fails, the customer is notified by email and invited to update their payment method; further attempts are made for about two weeks. If payment still has not gone through, the subscription is stopped and the account reverts to the Free plan: items beyond that plan's limits are paused, without any data being deleted.
7. Tokens, AI Photo Studio and training
Images and backgrounds generated by the AI Photo Studio and materials from the catalog are paid for in tokens (1 token = 0,50 excl. tax), purchased in packs. Tokens are credited to the account as soon as payment is made. Each paid plan offers welcome tokens once per customer; when upgrading to a higher plan, the customer receives the difference. Tokens do not expire and remain the customer's if the subscription is cancelled; they are lost when the account is permanently closed. They are neither refundable nor convertible into money, subject to the right of withdrawal set out in article 8. The AI Photo Studio is reserved for paid plans. A material bought from the catalog belongs to the customer and counts among their plan's active materials.
Custom training sessions are sold by the hour, separately; after payment, 3DVue contacts the customer to schedule an appointment. The onboarding session (Business plan) and the 2-hour training (Premium plan) are offered once per customer.
8. Right of withdrawal (consumers)
The consumer customer has 14 days from the date of purchase to withdraw, without having to justify themselves, by sending an unambiguous statement (for example the form below) to support-client@3dvue.fr. 3DVue then refunds the amounts paid within 14 days, using the same payment method.
- Subscription : as the service is made accessible as soon as the customer subscribes, at their request, withdrawal within the time limit gives rise to a refund of the price, less the amount corresponding to the period already elapsed.
- Tokens : tokens are digital content supplied immediately. By purchasing them, the customer expressly requests their immediate supply and waives their right of withdrawal (article L221-28, 13° of the French Consumer Code).
- Training : withdrawal is possible as long as the training has not taken place. Training fully carried out during the withdrawal period, at the customer's express request, no longer gives rise to a right of withdrawal.
9. Term and termination
Paid plans have no minimum term. The customer can cancel their subscription at any time from "My account"; cancellation takes effect at the end of the period already paid for, with no refund for the current period, and the account is then paused, without any data being deleted. Permanent deletion of account data can be requested at support-client@3dvue.fr.
3DVue may suspend or close an account in the event of a serious breach by the customer of these terms (unlawful content, fraud, harm to the service's security), after a formal notice has gone unanswered, except in an emergency.
10. 3DVue's commitments
3DVue uses reasonable means to ensure the availability, continuity and security of the service and of the customer's data, to fix reported issues as quickly as possible, and to adapt the service to changing load. Occasional interruptions may occur for maintenance. 3DVue is bound by a best-efforts obligation.
11. Liability and warranties
The customer is solely responsible for the content (3D models, textures, images, text) they upload and warrants that they hold the necessary rights; they indemnify 3DVue against any third-party claim on this matter.
Business customer : 3DVue's liability is limited to direct, proven damages, capped at the amounts paid by the customer during the 12 months preceding the event giving rise to the claim. 3DVue is not liable for indirect damages (loss of revenue, customers or data).
Consumer customer : they benefit from the legal warranty of conformity for digital content and services (articles L224-25-12 et seq. of the French Consumer Code). In the event of non-conformity, they can obtain the service being brought into conformity or, failing that, a price reduction or termination of the contract. No clause in these terms limits their legal rights.
12. Intellectual property
The 3DVue brand, the logo, the software, the site and their content are protected by intellectual property law. Any reproduction or use without written authorization is prohibited. The subscription grants the customer a personal, non-exclusive right to use the service for the duration of the subscription.
The customer remains the owner of the 3D models, materials and visuals they host or generate through the service. They authorize 3DVue to host, process and display them only to the extent necessary for the service to work.
13. Personal data
The customer's data is processed in accordance with the privacy policy, which specifies their purposes, recipients and the customer's rights (access, rectification, erasure, objection, portability, restriction).
14. Force majeure
3DVue is not liable for any delay or failure to perform resulting from a case of force majeure within the meaning of article 1218 of the French Civil Code.
15. Transfer of the contract
3DVue may transfer the contract to any natural or legal person taking over operation of the service, provided the customer's rights are not reduced. The customer is notified by email; the consumer customer may then cancel their subscription free of charge.
16. Complaints and mediation
Any complaint should be sent first to support-client@3dvue.fr. Every complaint receives a response as soon as possible.
Business customer : they may turn to the business mediator for an amicable resolution.
17. Applicable law and disputes
These terms are governed by French law. Failing an amicable agreement, any dispute with a business customer falls under the exclusive jurisdiction of the courts of Montpellier. The consumer customer may, at their choice, bring the matter before the court of the place where they lived when the contract was concluded or the harmful event occurred, or any other court with jurisdiction under the law.
